1. Acceptance of Terms

By accessing and using SimpleFlags ("Service"), provided by Artemis Ventures (Pty) Ltd ("Company," "we," "us," or "our"), you agree to comply with and be bound by these Terms of Use ("Terms"). If you do not agree with these Terms, you must not use our Service.

2. Description of Service

SimpleFlags is a feature flag management service designed for software development teams. It allows users to control software features based on specific customers or segments, and manage feature roll-outs group by group. The Service includes a web dashboard for managing features, user groups, environments, team members, and an API for referencing feature flag statuses.

3. User Responsibilities

Users agree to:

• Comply with all applicable laws and regulations.
• Respect our intellectual property rights.
• Ensure the accuracy and legality of any data or content they input into the Service.
• Use the Service only for its intended purposes and not for any harmful or disruptive activities.
• Properly manage team invitations and ensure that only authorized individuals have access.

4. Prohibited Activities

Users are prohibited from:

• Hacking, reverse engineering, or attempting to hack or reverse engineer the Service.
• Bypassing or attempting to bypass any limitations or security measures of the Service.
• Using the Service for any unlawful purposes or to promote illegal activities.
• Scraping or collecting data from the Service through automated means without authorization.
• Engaging in any activity that disrupts or interferes with the Service.

5. Payment and Subscriptions

SimpleFlags offers various subscription plans, which are managed through Stripe. Users can cancel their subscription at any time, and the cancellation will take effect at the end of the current billing cycle. Refunds are handled according to our separate refund policy.

6. User Data and Privacy

By signing up for or using the Service, users consent to the collection, use, and processing of their data in accordance with our Privacy Policy. Users must ensure that all personal data they provide is accurate and up-to-date.

7. Use of Google APIs

SimpleFlags' use of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

8. Limitation of Liability

To the maximum extent permitted by law, SimpleFlags and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from:

• The use or the inability to use the Service.
• Any unauthorized access to or alteration of your transmissions or data.
• Any other matter relating to the Service.

Users acknowledge that the use of SimpleFlags involves certain risks, including but not limited to, service disruptions and misconfigurations that may affect their software's performance. SimpleFlags cannot be held liable for any damages resulting from such issues.

9. Termination of Service

We reserve the right to terminate or suspend user access to the Service at our discretion, including but not limited to, violations of these Terms or non-payment of subscription fees. In cases of non-payment, the Service may be suspended after one week of non-payment. For other reasons, we will provide at least three months' notice before termination, except where immediate termination is necessary to comply with legal requirements or to protect our interests.

10. Intellectual Property

All intellectual property rights in the Service and its content, including but not limited to, software, design, text, graphics, and logos, are owned by Artemis Ventures (Pty) Ltd. Users are granted a limited, non-exclusive, non-transferable license to use the Service solely for their internal business purposes. Users may not copy, modify, distribute, sell, or lease any part of the Service or its content without our prior written consent.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of South Africa. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
